Terms of Service

Interpretation and definitions

"Company" (referred to as "we", "us", or "our") means Axenda, operating from the Kingdom of Saudi Arabia. "Application" means Khotta. "Service" means the Application together with khotta.io and our related websites and APIs. "You" means the individual using the Service, or the company or other legal entity on whose behalf that individual uses the Service.

Acknowledgment

These Terms are the agreement between you and the Company and set out the rights and obligations of all users. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms, and with our Privacy Policy, which is incorporated here by reference.

You represent that you are over the age of 13. The Service is not available to anyone under 13.

Accounts

When you create an account you must provide accurate and complete information. You are responsible for safeguarding the credentials you use to access the Service and for any activity carried out under your account.

You must notify us immediately if you become aware of any breach of security or unauthorised use of your account.

Subscriptions and purchases

Parts of the Service are offered on a paid subscription basis. Subscriptions are billed in advance on a recurring basis through the app store or payment provider you purchased through, and renew automatically unless cancelled.

You may cancel at any time through your app store account or subscription settings. Cancellation takes effect at the end of the current billing period, and access continues until then. Refunds are governed by the policy of the store or payment provider that processed your purchase.

Acceptable use

When using the Service, you agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable regulation.
• Attempt to gain unauthorised access to the Service, other accounts, or our systems and networks.
• Interfere with or disrupt the integrity or performance of the Service, including through automated scraping or excessive request volumes.
• Upload malicious code, or content that infringes the rights of others.
• Resell, sublicense, or commercially exploit the Service without our written permission.

Your content and our intellectual property

The content you create in the Application remains yours. You grant us a limited licence to host, store, and process it for the sole purpose of operating and improving the Service.

The Service itself, including its design, software, and trademarks, remains the exclusive property of the Company and its licensors. These Terms grant you no right to use our branding without prior written consent.

Termination

We may suspend or terminate your access immediately, without prior notice, if you breach these Terms. You may terminate at any time by deleting your account.

Upon termination your right to use the Service ceases at once. Provisions that by their nature should survive termination will remain in effect.

Disclaimer and limitation of liability

The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any data will be permanently retained without loss. You are responsible for maintaining your own backups of important information.

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, or consequential damages, or for loss of data, profits, or goodwill arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

Governing law, changes, and contact

These Terms are governed by the laws of the Kingdom of Saudi Arabia, without regard to conflict of law principles.

We may revise these Terms at any time. Where a revision is material we will give reasonable notice before it takes effect. By continuing to use the Service after revisions take effect, you agree to be bound by them.
